Intel wins battle against €1.06 billion antitrust fine

Intel won this Wednesday (26) a battle against a fine of € 1.06 billion (about R$ 6.5 billion, at the current price) in an antitrust case by the European Union. The 12-year lawsuit came after the US giant strangled competing companies.

The result is a defeat for European regulators and the decision was taken by the continent's second largest court, accepting Intel's defense. That could be in favor of Alphabet, which owns Google, which is also fighting an antitrust fine imposed by the European Union. Apple, Amazon and Facebook are other tech giants facing similar lawsuits.

The European Commission fined Intel in 2009. It accused the company of hampering rival Advanced Micro Devices (AMD). For this, the processor maker gave discounts to computer brands, such as Dell and Lenovo, for buying most items from Intel.

The court, located in Luxembourg, criticized the commission's decision to overturn the fine. “The Commission's analysis is incomplete and does not make it possible to establish basic legal requirements that discounts had the capacity to create anti-competitive effects”, highlighted the judge.

Now, the European Commission will study the cancellation of the fine to decide what to do next. Naturally, regulators do not accept discounts such as those given by Intel, the dominant companies, as they make it difficult for smaller companies to compete in the market.

“This is a big win for Intel. It raises the bar for the Commission in bringing dominance cases. She will have to do an effects-based analysis for each case. This will have an impact on all companies,” said Assimakis Komninos, from the law firm White & Case, in defense of the manufacturer.
